terms of use

the short version

  • You must be 13 or older. If you're under 18, use heart.zip with a parent's or guardian's permission.
  • Everything you write and upload stays yours.
  • heart.zip is a diary and a place to have fun, not medical advice or a crisis service.
  • mood+ is an optional monthly subscription. It renews automatically until you cancel it in your app store settings.

1. agreeing to these terms

These terms are an agreement between you and the developer of heart.zip ("we", "us"; see the contact section at the end) about using the heart.zip app and website. By creating an account or using heart.zip, you agree to these terms and to our privacy policy. If you don't agree, please don't use heart.zip.

2. who can use heart.zip

You must be at least 13 years old. If you're under 18, or under the age of digital consent where you live, you need a parent's or guardian's permission, and they agree to these terms for you. If you're a parent or guardian, you're responsible for your teen's use of heart.zip, including any purchases.

3. your account

  • You sign in with your email address or phone number and a one-time code. Keep access to that email or phone safe, since anyone who can read your codes can open your account.
  • An account is for one person. Don't use someone else's account or share yours.
  • Give us a real email address or phone number that belongs to you.
  • Tell us right away if you think someone else got into your account.

4. your content

Your check-ins, diary pages, photos, profile and everything else you add ("your content") belong to you. You give us permission to store, copy, sync and display your content only to run heart.zip for you, for example saving it to your account and showing it on your other devices and on cards you choose to share. This permission ends when you delete your content or your account, except for copies we must keep by law.

Only add content you have the right to use. Don't upload photos of other people without their permission.

5. using heart.zip nicely

Please don't:

  • break the law or use heart.zip to harm, threaten or harass anyone;
  • upload anything illegal, including any sexual content involving minors (we report this to the authorities);
  • try to get into other people's accounts or data, or get around mood+ without paying;
  • hack, overload, scrape or interfere with heart.zip, or copy, reverse engineer or resell the app, except where the law allows it.

We may suspend or close accounts that break these rules.

6. not medical advice

heart.zip helps you notice your moods and write about your day. It isn't therapy, a diagnosis or a medical service, and nobody monitors what you write. If you're thinking about hurting yourself or you're in danger, call or text 988 (Suicide & Crisis Lifeline, US), call your local emergency number, or talk to an adult you trust.

7. mood+ subscription

heart.zip is a paid app: you buy it once from the App Store or Google Play, and check-ins, your diary, month view, my corner and the included arcade games are yours to keep using with no subscription. mood+ is an optional subscription on top that unlocks extra arcade games, themes, stickers and features. Refunds for the app purchase are handled by Apple or Google under their policies.

  • Price: the price is shown in the app before you buy, in your local currency (for example $2.99 per month in the US). Taxes may apply.
  • Payment: you buy mood+ through the Apple App Store or Google Play, and payment is charged to that account. Their payment terms also apply.
  • Free trial: if a free trial is offered, it turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. You can only get a free trial once.
  • Automatic renewal: the subscription renews every month at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
  • Cancelling: manage or cancel anytime in your Apple ID or Google Play subscription settings (in the app: my corner → arcade.exe → manage). After you cancel, mood+ stays on until the end of the period you already paid for. Deleting the app or your heart.zip account doesn't cancel the subscription.
  • Refunds: Apple and Google handle refunds under their own policies. Contact them to ask for one.
  • Price changes: if the price changes, you'll be told in advance as Apple's and Google's rules require, and you can cancel before it applies.
  • Restoring: on a new phone, use "restore purchases" on the mood+ screen.

8. games and extras

Arcade games, scores, stickers and themes are for fun. They have no money value, can't be exchanged, and may change over time. The games are original and are not affiliated with any other game company.

9. changes, breaks and ending

We keep improving heart.zip, so features may change, and sometimes the app may be unavailable for maintenance or problems outside our control. You can stop using heart.zip and delete your account whenever you want (my corner → privacy.txt → delete my account). We may suspend or end your access if you break these terms, or if we have to stop offering heart.zip. If we shut down heart.zip, we'll try to give you notice and a chance to download your diary first.

10. disclaimers and limits

heart.zip is provided "as is" and "as available". To the fullest extent the law allows, we don't promise that it will always be available, error-free, or that data can never be lost, so keep copies of anything important. To the fullest extent the law allows, we're not liable for indirect or consequential losses, and our total liability to you is limited to the greater of the amount you paid us for mood+ in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer law that can't be waived.

11. Apple App Store terms

If you downloaded heart.zip from the Apple App Store: these terms are between you and us, not Apple, and we (not Apple) are responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to meet a warranty that applies, you can tell Apple and Apple will refund the purchase price (if any); otherwise Apple has no other warranty obligation. Apple isn't responsible for claims about the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. You confirm you're not in a country under a US government embargo and not on a US government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you. Your use must also follow the App Store's Usage Rules.

12. the law that applies

These terms are governed by the laws of the State of Florida, United States, except where the law of the place you live gives you protections that can't be changed by agreement. Before taking any legal step, please email us first so we can try to sort it out.

13. changes to these terms

We may update these terms. We'll change the date at the top, and if a change is important, we'll tell you in the app before it takes effect. If you keep using heart.zip after that, you agree to the new terms.
